While this is a fully private, 'entire home' experience with your own entrance and no shared interior amenities, the property is a historic duplex with another unit on the back of the house. We have invested in professional acoustic soundproofing to ensure your stay is as quiet and private as possible.
👥 Groups:
The Property has beds for up to 5 people assuming double occupancy in queen and use of trundle bed. However, beds are not necessarily indicative of allowed occupancy, and Owner may provide options for additional occupants in its sole discretion. Maximum Occupancy refers to all persons over the age of one year old. Violations can cause property damage, as well as violating local laws and regulations. In addition to other available remedies, violations of Maximum Occupancy will result in an additional charge of $50 per day representing liquidated damages.
⚠️ Damages:
The Property is delivered in clean and habitable condition and Guest must return in similar condition. Immediately upon arrival, Guest agrees to notify Owner of any noticeable damage or conditions requiring repair or maintenance. Guest agrees to be responsible for any damage to the Property during their rental stay. This includes damages to the furnishings and household items that result from the action or inaction of Guests or their invitees or pets, excluding normal wear and tear.
🚨Accidents and Liability:
Guest must immediately report to Owner any accidents or injuries. Owner’s maximum liability to Guest is limited to rental monies paid by Guest. Indemnification. Guest shall indemnify, defend, and hold harmless Owner, its agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of or related to Guest’s use or occupancy of the Property, including but not limited to personal injury, property damage, violations of law, or breaches of this Agreement. Limitation of Liability. To the fullest extent permitted by law, Owner shall not be liable for any indirect, incidental, consequential, or special damages, including loss of use, loss of enjoyment, travel disruption, or lost profits. Owner shall not be liable for the acts or omissions of third parties, including utility providers, internet services, or neighboring properties. In no event shall Owner’s liability exceed the total amounts paid under this Agreement. Assumption of Risk. Owner does not provide insurance coverage for Guest’s personal property or liability. Guest assumes all risk of loss, damage, or injury arising from use of the Property and is encouraged to obtain travel and renter’s insurance. Owner is NOT responsible for Guests’ personal belongings that are lost, stolen, damaged, or left behind. If items are found and are able to be returned, a $25 handling fee, plus shipping, will be charged to the Guest.
📋 Additional provisions/disclosures:
a. Owner makes every effort to provide accurate information about the Property, but no warranty as such is expressed or implied. The website will contain the most up-to-date information; however, décor, bedding, furniture or other amenities may change from time to time, and no refunds will be made for such. Owner shall not be liable for unintentional errors, omissions, or changes.
b. These provisions are severable, and the unenforceability or invalidity of any provision shall not affect the remainder of the provisions. The parties acknowledge that it is their intention that if any provision is determined by a court to be unenforceable or invalid as drafted, that provisions should be construed in a manner designed to effectuate the purpose of that provision to the greatest extent possible under applicable law. The parties hereby consent to the scope of such provision being judicially modified accordingly in any proceeding brought to enforce that provision.
c. Guest shall pay all reasonable costs, attorneys' fees and expenses incurred by Owner. This rental shall be governed by the laws of the State of North Carolina with jurisdiction and venue being in Wake County.
d. Time is of the essence with respect to all obligations.
e. All provisions relating to indemnification, damages, payment obligations, and limitations of liability shall survive termination or expiration of this rental.
f. Noise Ordinance: The Holden House is located in a quiet neighborhood and has a low noise tolerance. The home is under a noise ordinance between 10 p.m. and 8 a.m. It is not suitable for groups that are looking for late nights of partying outside.
g. Guest is fully and solely responsible for any injuries or accidents that an invitee may suffer. The Guest agrees to indemnify, defend and hold Owner harmless for any claims made by Guest’s invitees arising from use of the Property.
h. Guest understands the risks discussed above and agrees to assume all responsibility for the consequences of those risks. Guest has waived any and all claims whatsoever against Owner and their members, agents and representatives for accidents, injuries, loss or claims arising from use of the Property.
i. Guest acknowledges and agrees that any insurance for property damage or loss, which Owner may maintain on the Property, does not cover the personal property of Guest and Guest should purchase their own insurance for themselves.
j. Utilities; Excessive Usage. Owner shall provide and pay for standard utility services and usage to the Property (including, as applicable, electricity, water, sewer, gas, internet, and trash) based on ordinary residential use for the occupancy permitted under this shall be responsible for any excessive or abnormal utility consumption during the Rental Period. “Excessive” usage shall mean consumption materially above typical levels for the Property, as determined by comparison to historical usage for the Property. Owner may bill Guest for such excess amounts, together with reasonable administrative costs, upon providing copies of utility statements or other reasonable documentation. Any such amounts shall be due within five (5) days of notice and may be deducted from the security deposit to the extent permitted by applicable law. Guest shall also be responsible for excessive utility usage resulting from misuse, including but not limited to operating HVAC systems with doors or windows open, setting extreme temperatures, or otherwise failing to use utilities in a reasonable manner.
