VACATION RENTAL COVENANTS FOR 52 CUMMINGS WAY, LAKE PLACID, NEW YORK 12946
This Agreement is made between MC Del Properties, LLC of Queensbury, New York (hereinafter referred to as OWNER)
who own and operate the rental property located at 52 Cummings Road, Lake Placid, New York 12946.
Placid Peaks House consists of four units: Marcy; Whiteface; Cascade; Giant;
And the Tenant(s): as per AIRBNB agreement; All AIRBNB terms are agreed upon by both parties, and in addition, the Tenant and Landlord agree to the following covenants that are hereby made part of this AIRBNB rental:

1. GOOD NEIGHBOR POLICY: Quiet hours are from 9pm until 7am; We will enforce this rule. Please treat this property with the same care you would use with your own residence and leave it in the same condition it was in when you arrived. You and your occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighbors, traffic flow or the community and that will not prompt complaints to us from police, neighbors or neighborhood homeowners. This is a family-oriented vacation rental property with neighbors; If your plans are to party past 9pm with loud music and conversation, please choose another vacation rental. Complaints during quiet hours and/or noise complaints may result in the tenant being required to vacate the property. See Town of North Elba policy: (Note: link is not permitted on this listing, to be provided in the rental agreement).


2. Parking: No boats, RV’s ect. This property is limited to a specific amount of off-street parking as set forth in the property description. You and your occupants agree to abide by all applicable parking restrictions and limitations. [Parking spaces: Marcy-3, Whiteface-3, Cascade-2, Giant-2, Marcy/Giant-5]

3. Tenant agrees to notify the OWNER if Tenant is not satisfied with the unit/home in any way (cleanliness, amenities, condition, ect.) immediately upon Tenant’s arrival so that arrangements to remedy complaints may be made. Tenant further agrees to notify OWNER immediately of any situation arising which requires emergency attention, i.e., broken water pipes, clogged toilet or drain, no heat, etc..

4. Tenant shall not assign this agreement or sublet the premises without written consent of the Landlord/OWNER.

5. Tenant shall permit the Landlord/OWNER or his/her caretaker to enter the leased premises at any reasonable hour of the daytime to inspect or to make or have made reasonable repairs.

6. Tenant shall not alter the premises in any way without written consent of the OWNER. Tenant assumes responsibility and expenses for all repair of damage resulting from abuse or neglect by Tenant and/or Tenant’s family or guests during the term of occupancy. Tenant agrees to surrender the premises and in as good a condition as they were at the time the Tenant took occupancy.

7. Check out time is 10am and is strictly enforced as another rental may be checking in the same day;

8. Your Check Out Cleaning Responsibilities: Please leave this property in the same general condition as it was when you arrived. Clean all food and drink spills immediately. Be aware that food and drink spills on carpet and furnishings constitutes damage to the property, not normal wear and tear. Remove all food from refrigerator; do not leave dirty dishes, pots and pans…start a load of dishes in the dishwasher using “sanitize” setting; strip dirty linens from beds and place them in the laundry room. Cleaning staff will arrive shorty after your departure to thoroughly clean and inspect the property. Excessive cleaning charges will be deducted from your security deposit;
9. Overnight occupancy is limited to the maximum number of guests allowed, as per the AIRBNB listing agreement; Tenant agrees that any violation of this occupancy limit without consent of the Landlord/OWNER shall result in a breach of this agreement. Tenant agrees to vacate the premises and forfeit all rent and security deposit. “Short Term” is less than 30 consecutive nights.

10. Landlord agrees that the plumbing, heating, and electrical systems, together with all appliances provided for the use by Tenant, are in good working condition.

11. PETS ALLOWED only when renting “Cascade”, “Giant” or the combined unit “Marcy/Giant” with prior permission from owner…see rules for pet owners below (#18). Pets are NOT ALLOWED when renting “Marcy” or “Whiteface”.

12. NO SMOKING INSIDE THE PROPERTY. In the event you do smoke outside, please discard all cigarette butts in a suitable container, not on the yard.

13. Do not wear high heels, spiked heels, golf cleats or abrasive footwear on wooden floors.

14. Security Deposit is held by AIRBNB and will be returned in 7 days after check out if no damage is reported; Said deposit may be used by the Landlord to remedy any breach of any covenant contained in this Agreement, for any damage to the premises, beyond normal wear and tear, by Tenant or Tenant’s family or guests, for service charges incurred by the Tenant as outlined in any covenant of the Agreement or for other charges owed to Landlord by Tenant. Landlord agrees to notify the Tenant if there is any damage that gives reason to use any funds that are part of the security deposit within 7 days; if no damage has occurred the deposit will be returned to the tenant.

15. Inspection: In the event Tenant shall not make prior inspection of the premises, Tenant agrees to lease the premises “as is”, subject to any state of facts that a personal inspection would show. Landlord/OWNER shall not be responsible for providing any item or service not present in the premises which would have been disclosed by personal inspection.

16. Cancellation terms can be found on the AIRBNB listing and are reviewed by the tenant prior to signing agreement.

17. MC Del Properties, LLC, due to unforeseen circumstances, cannot guarantee rental property locations. If the property hereby described above and reserved is not able to be occupied from situations out of the Landlord’s control during the above rental time, MC Del Properties, LLC will make all efforts to provide a suitable and comparable rental property, or will refund the Tenants monies paid.

18. PET ADDENDUM: This addendum is made part of an incorporated into the parties Rental Agreement through AIRBNB.
Owner: MC Del Properties, LLC, Queensbury, NY Premises: 52 Cummings Road, Lake Placid, New York 12946 Rental deposit may be used for any damages or any portion of this agreement which is broken; Tenant Agrees: 1. To keep the pet on a leash at all times outside the individual apartment/condo; a. This includes all common areas inside the building and all areas outside of the building. 2. To never leave the pet unattended in the home; 3. Tenant guarantees that the pet will not damage any property inside or outside of the property and in the event they do, the repairs will be taken out of the deposit; 4. To not allow pets on the furniture; 5. To hold owner harmless from all liability arising from Tenant’s ownership or keeping of the pet; 6. To clean up after the pet and to dispose of their pet’s waste properly and quickly; 7. To never leave food outside of the property to attract other animals; 8. Tenant guarantees the following: a. Rabies vaccine for the pet is current b. Tenant’s home or renters insurance contains a minimum of $500,000 coverage for any incidents involving pet. Tenant’s breed must be covered by the policy. 9. To
the following restrictions. The pet does not meet any of the characteristics described in items 9a-9f. (These restrictions are specific to property insurance coverage limitations). a. pure bred terriers commonly known as “pit bull” dogs including, but not limited to, Staffordshire Terriers, Staffordshire Bull Terriers and/or American Pit Bull Terriers; b. pure bred Doberman Pinschers, Rottweilers, Chows and Presa Canarios dogs; c. pure bred or hybrid canines with 25% or more of their ancestry traceable to coyotes (Canis latrans) or wolves (Canis lupus); d. canines that have been trained to guard or attack people, property or other animals. Guide dogs, hearing dogs and other dogs specially trained to assist the physically challenged are exempted from this exclusion; e. canines that have been bred or trained as fighting animals; and f. any canine that has a history of one or more attacks on people, property or other animals that is verifiable from insurance claims records, police or public record sources.
Consequences of Breach: Any failure by you or any other occupants to comply with any of the terms of this agreement may result in a forfeiture of your rights to rent the property, up to and including immediate eviction from the Property without refund. In addition, you are responsible for and you authorize us to deduct from any deposit your made with us and, if your deposit in not sufficient to cover the full amount, to bill your credit card on file the full amount of damage.

Landlord/Owner and Tenant agree that the covenants contained in this Agreement shall bind the parties hereto, their heirs, assigns or legal representatives. No modifications to this agreement shall be made without written approval of the OWNER.
