US Gift Card Terms and Conditions

These Gift Card Terms and Conditions for US Users apply to you if your country of residence or establishment is within the United States. If your country of residence or establishment is outside of the United States, find the gift card terms that apply to you.

These United States Gift Card Terms and Conditions ("Gift Card Terms") govern your use of Airbnb Gift Cards ("Gift Cards") on the Airbnb Platform. These Gift Card Terms constitute an agreement between you, the Cardholder, and Airbnb Gift Card Services, LLC. By purchasing or using your Card, you agree to be bound by these Gift Card Terms. IMPORTANT: These Gift Card Terms include resolution of disputes by arbitration on an individual basis instead of in court.


Your use of Gift Cards and the services available via the Airbnb Platform shall be subject to Airbnb’s Terms of Service (“Terms“) and Payments Terms of Service (“Payments Terms”). If you see an undefined term in these Gift Card Terms, it has the same definition as in the Terms and Payments Terms.

1. About Your Card.

Gift Cards sold in the U.S. are issued by Airbnb Gift Card Services, LLC (“Issuer”). Gift Cards can be purchased through www.airbnb.com/giftcards and from authorized third-party distributors. Gift Cards may be issued in either electronic or physical form, at the discretion of Issuer.

You must have an Airbnb account in order to use a Gift Card. If you do not have an Airbnb account, you’ll need to create one in order to use a Gift Card. You can add a Gift Card to your Airbnb account by visiting www.airbnb.com/gift. Once added, the entire Gift Card value will be transferred to and shown on your Airbnb account as your Gift Card balance. Gift Card balance(s) may only be redeemed toward the purchase of goods and services offered on the Airbnb Platform. Any purchase made with a Gift Card will be deducted from your Gift Card balance(s), and any unused Gift Card balance(s) will remain on your Airbnb account until used. If a purchase exceeds your existing Gift Card balance(s), the remaining amount due must be paid with another Payment Method. You can view your Gift Card balance(s) by signing in to your Airbnb account.

2. Expiration; Fees.

No fees of any kind apply to Gift Cards, and Gift Cards and Gift Card balance(s) do not expire.

3. Limitations.

Gift Cards purchased in the United States (not including U.S. territories or possessions) can only be used by individuals residing in the United States, not including U.S. territories and possessions.

Gift Cards may not be applied towards charges for changes to existing reservations or used to purchase other Gift Cards. Gift Cards cannot be reloaded, resold, transferred for value or redeemed for cash, except to the extent required by law. Gift Cards have no cash value. Once a Gift Card is claimed to an Airbnb account, its value cannot be transferred to another person or Airbnb account; a Gift Card balance on an Airbnb account may not be cashed out or transferred to another Airbnb account.

4. Lost, Stolen or Destroyed Gift Cards; Gift Cards Used Without Permission.

Please safeguard your Gift Card. Once a digital Gift Card is electronically transmitted to the purchaser or designated recipient, or a physical Gift Card is delivered to the purchaser or designated recipient, whichever is applicable, the risk of loss and title for the Gift Card pass to the purchaser or designated recipient. Issuer is not responsible if any Gift Card is lost, stolen, destroyed or used without your permission.

5. Fraud.

Issuer and its affiliates reserve the right to refuse to issue or honor a Gift Card or pursue any other legal remedy, in the event of suspected fraud. Issuer and its affiliates also reserve the right to refuse to honor a Gift Card that is obtained from unauthorized sellers and resellers. Issuer and its affiliates have the right to close an Airbnb account and charge alternative Payment Methods if a fraudulently obtained Gift Card is added and/or used to make or attempt purchases on the Airbnb Platform.

6. Limitation of Liability.

Issuer and its affiliates make no warranties, express or implied, with respect to Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event a Gift Card is non-functional, your sole remedy, and our sole liability, will be the replacement of such Gift Card. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have additional rights.

7. Termination; Waiver

Your rights under a Gift Card will terminate if you materially fail to comply with these Gift Card Terms or if your Airbnb account is terminated or is suspended. Upon termination, you must cease all use of the Gift Card, and we may revoke your access to any Gift Card balance. Our failure to insist upon or enforce your strict compliance with these Gift Card Terms will not constitute a waiver of any of our rights.

8. Mandatory Binding Dispute Resolution and Individual Arbitration Agreement.

8.1 Application. This Arbitration Agreement applies to any dispute, claim or controversy arising out of or relating to these Gift Card Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of services provided by Issuer and its affiliates with respect to Gift Cards. If you attempt to bring any legal claim against Issuer in the United States, this Arbitration Agreement will apply for determination of the threshold issue of whether this Section 8 applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.

8.2 Overview of Dispute Resolution Process. Issuer is committed to participating in a consumer-friendly dispute resolution process. To that end, these Gift Card Terms provide for a two-part process for individuals to whom this Section 8 applies: (1) an informal negotiation directly with Airbnb’s customer service team (described in Section 8.3), and if necessary (2) a binding arbitration administered by the American Arbitration Association (“AAA”). You and Issuer each retain the right to seek resolution of the dispute in small claims court as an alternative to arbitration.

8.3 Mandatory Pre-Arbitration Dispute Resolution and Notification. At least 30 days prior to initiating an arbitration, you and Issuer each agree to notify the other party of the dispute in writing and attempt in good faith to negotiate an informal resolution. You must send your notice of dispute to Issuer by mailing it to Issuers’ agent for service: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833. Issuer will send its notice of dispute to the email address associated with your Airbnb account. A notice of dispute must include: the party’s name and preferred contact information, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written Demand for Arbitration (available at www.adr.org) with the AAA and providing a copy to the other party as specified in the AAA Rules (available at www.adr.org).

8.4 Agreement to Arbitrate. You and Issuer mutually agree that any dispute, claim or controversy arising out of or relating to these Gift Card Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of Gift Cards or use of services provided by Issuer and its affiliates with respect to Gift Cards (collectively, “Disputes”) will be settled by binding individual arbitration (the “Arbitration Agreement”). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to our Dispute, you and Issuer agree that the arbitrator will decide that issue.

8.5 Exceptions to Arbitration Agreement. You and Issuer each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in a judicial proceeding in a court of competent jurisdiction (as defined by Section 8): (i) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g., imminent danger or commission of a crime, hacking, cyber-attack); (ii) a request for the remedy of public injunctive relief; or (iii) any individual claim of sexual assault or sexual harassment arising from your use of the Airbnb Platform or Host Services. You and Issuer agree that the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the Federal Arbitration Act.

8.6 Arbitration Rules and Governing Law. This Arbitration Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs all substantive and procedural interpretation and enforcement of this provision. The arbitration will be administered by AAA in accordance with the Consumer Arbitration Rules and/or other AAA arbitration rules determined to be applicable by the arbitrator (the “AAA Rules”) then in effect, except as modified here. The AAA Rules are available at www.adr.org. In order to initiate arbitration, a completed written demand (available at www.adr.org) must be filed with the AAA and provided to the other party, as specified in the AAA rules.

8.7 Modification to AAA Rules - Arbitration Hearing/Location. In order to make the arbitration most convenient to you, Issuer agrees that any required arbitration hearing may be conducted, at your option: (a) in the U.S county where you reside; (b) in San Francisco County; or (c) via phone or video conference. If the amount in controversy is $5,000 or less, the parties agree to proceed solely on the submission of documents to the arbitrator.

8.8 Modification of AAA Rules - Attorney’s Fees and Costs. Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Rules. Either party may make a request that the arbitrator award attorneys’ fees and costs upon proving that the other party has asserted a claim, cross-claim or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous, as allowed by applicable law and the AAA Rules.

8.9 Arbitrator’s Decision. The arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the AAA Rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.

8.10 Jury Trial Waiver. You and Issuer acknowledge and agree that we are each waiving the right to a trial by jury as to all arbitrable Disputes.

8.11 No Class Actions or Representative Proceedings. You and Issuer acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.

8.12 Severability. Except as provided in Section 8.11, in the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision shall be severed and the remainder of the Arbitration Agreement will be given full force and effect.

8.13 Changes to Agreement to Arbitrate. If Issuer changes this Section 8 after the date you last accepted these Gift Card Terms (or accepted any subsequent changes to these Gift Card Terms), you may reject that change by sending us written notice (including by email) within thirty (30) days of the date the change is effective. Rejecting a new change, however, does not revoke or alter your prior consent to any earlier agreements to arbitrate any Dispute between you and Issuer (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and Issuer.

8.14 Survival. Except as provided in Section 8.12, this Section 8 will survive any termination of these Gift Card Terms and will continue to apply even if you terminate your Airbnb account.

9. Miscellaneous.

Gift Cards sold in the United States (not including U.S. territories or possessions) are issued by Issuer. Issuer is responsible for the operation and maintenance of the Gift Card program. Issuer is the sole legal obligor to you, the Cardholder; provided, however, that Issuer may assign its obligations with respect to the Gift Card at any time, in which case such assignee shall become the Issuer and sole legal obligor to the Cardholder. Issuer’s affiliates and related entities bear no responsibility or liability for any Gift Cards, and you hereby knowingly release Issuer’s affiliates and related entities from any and all liability or claims of any nature whatsoever arising in connection with Gift Cards. When you purchase, receive, or use a Gift Card, you agree that the laws of the Commonwealth of Virginia, without regard to principles of conflict of laws, will govern these Gift Card Terms.

10. Severability.

Notwithstanding anything herein to the contrary, if any part of these Gift Card Terms is deemed invalid or inapplicable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable. If such provision cannot be so modified or restricted, it shall be excised from these Gift Card Terms without affecting the validity, legality, or enforceability of the remainder of these Gift Card Terms, which shall be fully enforced.

11. Changes to Gift Card Terms.

We reserve the right to modify these Gift Card Terms at any time. When we make material changes to these Gift Card Terms, we will post the revised Gift Card Terms on the Airbnb Platform and update the “Last Updated” date at the top of these Gift Card Terms. Your continued access to or use of the Airbnb Platform and/or failure to close your Airbnb account will constitute acceptance of the revised Gift Card Terms.
