Our condo was elegantly designed with a goal of making it one of the best in Maui. A newly installed dual AC - one in the living room and one in the bedroom. We are located in the D building, the building with a panoramic view of the ocean. It's also the building away from the street noise with a view of the upper pool. The condo is completely and tastefully update throughout, including the kitchen, bathroom, flooring, ceiling, appliances, etc.

Other things to note
• Check-in begins at 3PM, checkout no later than 11AM.
• Number of guests must not exceed the original number of guests during booking. People other than those in the Guest party as originally agreed upon may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest. Guests to check in with the Office at the earliest possible time. Office hours 8AM-6:30PM daily, except for holidays. Guest name and number will be listed at the office for a smooth check-in.
• Minimum rental age is 25. Primary adult occupant guest (25+) acknowledges that he or she is legally responsible for compliance by all occupants and guests of this short-term rental unit as outlined in the rental agreement.
• Guests to follow and practice state and federal regulations and recommended universal personal protection and disinfection protocols to limit transmission of all diseases. Despite our careful attention to cleaning, there is still a chance you could be exposed to an illness at the condo.
• Assignment/Subletting: Tenant shall not sublet all or any part of premises, or assign or transfer this Agreement or any interest in it.
• No pets allowed on or around the premises.
• Pack 'n Play is available for your convenience.
• Please do not spray sunblock in the condo.
• Please keep condo hallway clear and clean including but not limited to sand, sandals, beach gear, etc.
• Smoking is not allowed in the condo or around the complex, except for the designated smoking areas.
• Pool areas: No toys or floaties of any kinds. No lifeguard available at the pool. Lower pool hours: 8AM-9PM daily. Upper pool hours: 9AM-9PM. Guests to abide by pool rules & regulations. The use of the pool areas by non-registered persons is not permitted.
• Tennis/pickleball rackets are available to borrow at the Office.
• Parking: Guest shall register their vehicle at the Office upon arrival or as soon as practical thereafter and receive a parking permit, which shall be displayed on the rearview mirror. Parking is limited to one vehicle (#201). Parking in places other than the designated spaces is prohibited and strictly enforced. Any illegally parked vehicles are subject to towing: applicable fines/towing fees are the sole responsibility of the vehicle owner. Do not leave valuables in your vehicle.
• Noise Restrictions: Avoid creating “loud or unreasonable noise” during quiet time from 10 PM – 8 AM. No party or loud music allowed. Use of vacuum, dishwasher, washer/dryer is not permitted during quiet time.
• Trash must be placed in Association trash bin or drop down through the trash chute between 8AM-9PM.
• No daily maid service.
• Parents have full and sole responsibility to monitor and safeguard their children. No climbing on furniture or horse-playing on the lanai (balcony.)

Any concerns regarding the safety or condition of the aforementioned item should be immediately reported to the Host. Guest(s) agrees to comply with all applicable laws, regulations, and safety standards related to the use of the Pack ‘n Play, including but not limited to those concerning child safety and product safety. Guests to follow all manufacturer safety guidelines. Guests agree to indemnify and hold harmless the Host/Owner from any claims, damages, or liabilities arising from the use of the Pack ‘n Play by the Guests or any third party during their stay.
• All of the units are privately owned; the owners are not responsible for accidents, injuries, or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting the reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
• Call 9-1-1 for police, fire, and medical emergency.
• Keep the property and all furnishings in good order.
• Only use appliances for their intended purposes.
• Flex your power! AC to be turned off when you’re not home or check out.
• If temporary repair is required, you agree to permit access to the home for repairs upon notification. We shall not be liable to you for damages; no refund will be given in case of temporary failure. For example, planned or emergency water shutoff.
• Homeowner shall not accept liability for any inconvenience arising from stoppage in supply of water, gas, electricity, plumbing, internet/TV outage, weather conditions, natural disasters, acts of God, change in policy (rules & regulations) by the Maui/Hawaii or Home Owner Association (HOA), or reasons beyond his control.
• Cancellation: Cancellations must be received in writing and within the booking site agreement. Host may cancel reservation if payment is three days past due with no refund.
• Guests to abide by Kihei Akahi House Rules. A copy is available at the condo.
• Lost and found: Items left behind must be claimed within three calendar days after checked out. Found item can be shipped out for a fee. Items will be trashed after three days. Owner will not be responsible for lost or unclaimed items.
• Mediation: Tenant and Owner agree to mediate any dispute or claim arising between them out of this Agreement. Each party waives his right to trial by jury in any matter and action under this Agreement. Mediation fees, if any, shall be divided equally among the parties involved. Mediation location must be within 20 miles of this property.
• These terms may change from time to time.
The parties agree to the terms of this Rental Agreement, as evidenced by you making/accepting the reservation.
