SHORT TERM RENTAL AGREEMENT
This Short Term Rental Agreement (the “Agreement”) is made by and between Morgan Estates, LLC (“Homeowner”) and (“Guest”) and the parties hereby agree as follows:
- Property: The property fully furnished and is located at: Joshua Tree, CA
Rental Party: The rental party shall consist of Guest and the number of persons when booked.
- Maximum Occupancy: Guest agrees that no more than 10 persons shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement. No visitors allowed and violation will result in immediate eviction with no refund.
- Term of the Stay: You stay begins at 4pm (the “Check-in Date”) and ends at 11am (the “Checkout Date”). No exceptions without Homeowner's consent.
Minimum Stay: This property may require a minimum stay. Longer minimum stays may be required during holiday periods.
- Rental Rules: Guest agrees to abide by the Rental Rules below at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.
- Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
- Cleaning: The property shall be cleaned before Guest check-in. No daily cleanings.
Rental Rate and Fees
- Deposit & Rental Rate: The deposit (if any) and full rental rate is due upon booking. The deposit is for security and shall be refunded within 7 days of the Checkout Date provided no deductions are made due to:
i. damage to the property or furnishings;
ii. dirt or other mess requiring excessive cleaning; or
iii. any other cost incurred by Homeowner due to Guest’s stay.
If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately.
- Cancellation Policy: If Guest wishes to cancel his/her reservation, the deposit will be refunded as follows:
Full refund for cancellations up to 30 days before check-in. If booked fewer than 30 days before check-in, full refund for cancellations made within 48 hours of booking and at least 14 days before check-in. After that, 50% refund up to 7 days before check-in. No refund after that.
Insurance: We encourage all renters to purchase traveler insurance.
- Liability: Morgan Estates, LLC assumes no liability for property loss or damages, nor liability for injuries, accidents, delays or irregularity which may be occasioned either by reason of defect in any vehicle conveying passengers to or from the property. Guests are responsible for the property during occupancy, must lock property's windows and doors securely at all times when not on the premises, and must exercise care in securing all personal property. Morgan Estates, LLC reserves the right to refuse service or rentals to anyone at their complete discretion.
- Payment: Payment can be made through the channel where the property is listed.
- Condition and Use of Property: The Property is provided in “as is” condition. Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, satellite or cable TV access or hot tubs, fireplaces as applicable. Homeowner shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of amenities such as hot tubs, pools, spas, fireplaces, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk.
- Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.
- Unavailability of Property: In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Homeowner, Homeowner will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, Homeowner shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.

RENTAL RULES
- Smoking is NOT allowed inside of our property and any illegal activity, drugs and hazardous materials are NOT allowed inside or outside of the property.
- People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest.
- House is privately owned; the Homeowners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. - The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
- Our backyard is the desert. Please keep the desert wildlife in the desert by keeping all doors and windows closed and do not feed the animals.
- Keep the property clean and all furnishings in good order. Excessive cleanings will incur an additional charge of $350 or more. This includes vomit on floors, walls, towels, bedding, etc. If you can't handle your alcohol, don't drink.
- Only use appliances for their intended uses.
- Pets or animals of any type are NOT allowed under any circumstances.
- Fire pit is only allowed on non-windy nights. Any cost incurred by a visit from the fire department for a guest caused incident is to be paid by the guest. Never leave fire unattended and DO NOT burn anything.
- Driveway parking is limited to 6 vehicles but there is ample street parking. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. Homeowners are not responsible for any damages to your vehicle. No parking of boat, truck, trailer or vehicle other than passenger car.
- Housekeeping: There is no daily housekeeping service. While linens, bath and hot tub towels are included in the home, daily maid service is not included in the rental rate. We do not permit towels, linens, chairs, or coolers to be taken.
- Water and Septic: The property is on a private septic system. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clog the septic system, you could be charged damages of up to $250.
- Quiet enjoyment and parties: We rent to family groups and responsible adults only; absolutely NO house parties, commercial use or functions such as weddings are not allowed without advance written permission from Morgan Estates, LLC. Guests shall be sufficiently quiet and peaceful, so as not to disturb other residents of the neighborhood, particularly after 10pm at night. If Guest is found to have had a wedding or any sort of group gathering for more persons than officially scheduled and paid for at the home, and/or without advance written permission, Guest is subject to forfeiture of entire security deposit in addition to an event fee to Morgan Estates, LLC.
- Hot tub: Swim at your own risk. No jumping or diving, running, rough play, food, and glass in the hot tub area. Children cannot use the hot tub without adult supervision. Do not exceed the water temperature of 102 degrees.
No fireworks, firearms or fire-lanterns of any kind. Any report of this type of activity will result in immediate expulsion from the home.
HOT TUB/SAUNA SAFETY RULES
- Supervision: Children under the age of 14 must be supervised by an adult at all times. Children under 5 years of age are not permitted in the hot tub/sauna, per CDC guidelines.
- Health Precautions: Do not use the hot tub/sauna if you are pregnant, have a heart condition, high blood pressure, or other medical concerns. Consult a physician before use if in doubt. Avoid entering the hot tub/sauna if you have open wounds, skin infections, or contagious conditions.
- Time Limits: Limit usage to 15-20 minutes to avoid overheating or dehydration. Take breaks between sessions.
- Prohibited Activities: No diving, jumping, or rough play in or around the hot tub/sauna. Do not use the hot tub/sauna under the influence of alcohol, drugs, or medications that may cause drowsiness or impair judgment.
- Water Safety: Do not add soaps, oils, or other foreign substances to the water. Ensure the sauna door is closed and hot tub is covered and secured when not in use to prevent unauthorized or unsafe access.
- Temperature Setting: The hot tub temperature can be control from the control panel and the sauna can be controlled from the control panel inside the sauna.
- Personal Items: Do not bring glass containers into the hot tub/sauna area. Remove jewelry and electronics before entering the hot tub/sauna.

Health risks due to prolonged exposure to high temperatures. Injury from misuse of the hot tub or failure to follow the safety guidelines. - Waiver of Liability: You agree to release, discharge, and hold harmless Morgan Estates, LLC, its owners, agents, and employees from any and all claims, damages, or liabilities for injuries, illnesses, or losses arising out of or related to hot tub/sauna use. This waiver applies regardless of whether the incident is caused by negligence.
- Indemnification: You agree to indemnify and hold harmless Morgan Estates, LLC, its owners, and agents against any claims, actions, or damages brought by others resulting from your use of the hot tub/sauna.
- Compliance with Rules: Failure to follow the posted rules may result in immediate eviction from the property without refund. You are responsible for ensuring all members of your party comply with these rules.
- Personal Responsibility: You acknowledge that you are responsible for: Supervising children and ensuring they follow safety guidelines. Monitoring your health and discontinuing use if any adverse symptoms occur.
